The use of the web site implies full acceptance of the general use terms and conditions described below. These use terms and conditions are subject to change or amendment at all times, users of the web site are therefore invited to read them regularly.

Normally, this site is accessible to users at all times. Polytropic may occasionally decide on an interruption for technical maintenance, in which case it will strive to communicate the dates and times to users beforehand.

The web site is regularly updated by JC Fillot. Similarly, the legal disclaimers may be changed at all times: they are nevertheless binding on users, who are invited to read them as often as possible.

3. Description of the provided services.

The purpose of the site is to provide information about all the company activities.

Polytropic strives to provide information that is as accurate as possible on the web site. However, it cannot be held liable for any omissions, incorrect information or missing updates whether due to itself or the third party partners that provide the information.

All the information given on the are indications only and are subject to change. Furthermore, the information featured on the web site is not exhaustive. It is therefore provided subject to changes made after its online publication.

4. Contractual limits to technical data.

The web site uses JavaScript technology.

The web site cannot be held liable for damage to property relative to use of the site. Furthermore, web site users undertake to access the web site using recent hardware, free of all viruses and using an updated last generation browser

5. Intellectual property and infringement.

Polytropic has ownership of the intellectual property rights or has a right to use all the accessible site elements, in particular the texts, images, graphics, logos, icons, sounds, software.

All reproduction, representation, alteration, publication, adaptation of all or part of the web site elements, by any means or using any technique, is prohibited unless previously authorised in writing by: Polytropic.

All unauthorised use of the web site or of any of the elements it contains will be considered an infringement and proceedings under articles L.335-2 and following of the French Intellectual Property Code will be taken.

6. Limitations to liability.

Polytropic cannot be held liable for direct and indirect damage caused to the user’s hardware when accessing the web site, resulting either from the use of equipment that does not meet the specifications indicated in item 4, or resulting from the appearance of a bug or incompatibility.

Similarly, Polytropic cannot be held liable for indirect damage (such as loss of markets or loss of opportunity) following the use of the web site

Interactive areas (possibility of asking questions using the contact area) are available to users. Polytropic reserves the right to remove any content placed in this space that is in breach of legislation applicable in France without notice, in particular the provisions relating to data protection. Where applicable, Polytropic also reserves the possibility of engaging users’ civil and/or criminal liability, in particular in cases of messages of a racist, offensive, libellous or pornographic nature, whatever the medium used (text, photograph, etc.).

Personal data management.

In France, personal data is especially protected by the n° 78-87 Act of 6 January 1978, the n° 2004-801 Act of 6 August 2004, article L. 226-13 of the French Criminal Code and the European directive of 24 October 1995.

When using the web site, the following data may be collected: the URL for the links the user used to access the web site, the user’s access provider, the user’s Internet Protocol (IP) address.

Polytropic only collect users’ personal data when it is required for certain services proposed by the web site. Users knowingly provide this data, in particular when they enter it themselves. At that time, users of the web site are notified whether they must provide this data or not.

In compliance with the provisions of articles 38 and following of the French 78-17, 6 January 1978 Data Privacy Act, all users have a right of access, correction and opposition over their personal data. This right can be exercised by sending a written and signed request accompanied by a copy of a signed identity document in which the return address is indicated.

No personal data belonging to users of the web site is published without their knowledge, nor exchanged, transferred or sold to third parties on any medium. Only the acquisition of Polytropic and its rights would allow to communicate the said data to the possible purchaser, who would have the same preservation and modification duties relative to web site users.

The web site has not been declared to the CNIL because it does not collect personal data.

The databases are protected by the provisions of the July 1st 1998 Act enacting directive 96/9 of 11 March 1996 covering the legal protection of databases.

8. Hypertext links and cookies.

The web site contains a number of hypertext links to other web sites, of which the implementation has been authorised by Polytropic. However, Polytropic has no means of checking the content of such visited web sites and, as a consequence, declines any resulting liability.

The use of the web site may result in cookies being installed on users’ computers. A cookie is a small file which cannot be used to identify users but which records data on the way the computer was used to browse the web site. The purpose of collecting such data is to facilitate future use of the web site as well as to provide site use statistics.

9. Governing law and jurisdiction.

All disputes relative to the use of the web site are subject to French law. Exclusive jurisdiction is given to the competent Paris courts.
